Opt Out of Processing of Sensitive Personal Data (Utah)

Pursuant to the UCPA, Utah consumers have a right to opt out of the processing of “sensitive personal data” that Acxiom has collected or maintained about them. “Sensitive personal data” includes personal data that reveals: (A) an individual’s racial or ethnic origin; (B) an individual’s religious beliefs; (C) an individual’s sexual orientation; (D) an individual’s citizenship or immigration status; or (E) information regarding an individual’s medical history, mental or physical health condition, or medical treatment or diagnosis by a health care professional; (ii) the processing of genetic personal data or biometric data, if the processing is for the purpose of identifying a specific individual; or (iii) specific geolocation data (1750 ft radius or less). Acxiom will treat a request to opt out of processing of sensitive personal data as a request to delete.

International Requests (i.e., requests from outside the U.S.)

To properly fulfill your request, please be sure to include your first, middle (if available), and last name, country of residence, physical address, valid email address and valid telephone number in the request.

Acxiom does not collect “personal data” or “personal information” in all countries. In certain countries, Acxiom only collects and processes anonymous and/or aggregated information. You will be notified as part of our response to your request if the country for which you requested an opt out is limited to anonymous or aggregated data only.

Prior to Acxiom’s fulfillment of a “right to know” and as necessary in certain instances a “right to delete request from a consumer as described below, Acxiom will require a consumer first verify their identity through a third-party identity verification service at no cost to the consumer.

Acxiom’s Online Consumer Portal

For all “right to know” requests submitted by a consumer through Acxiom’s online consumer portal, the following information will be required for the identity verification process:

• First, Middle (if applicable), and Last Name
• Physical address
• Date of birth (MM/DD/YYYY)
• Valid email address (which will be used as the direct form of communication with you)

Please note that Acxiom takes the privacy and security of individuals, and the data that we maintain about them, seriously. Please be prepared to receive multiple emails from Acxiom as part of the verification process, and please note that some of those emails include a time limit for your response. Please allow plenty of time to complete the verification steps and to respond to all confirmation messages issued by Acxiom. 

Telephone Requests

For all “right to know” access requests submitted through Acxiom’s toll-free telephone number, consumers will be required to provide the following information for the identity verification process:

• Date of birth
• Valid telephone number
• Valid email address (if available and would like content delivered via email)

For “right to know” access requests submitted through Acxiom’s toll-free telephone number, an Acxiom associate will call you to administer an identity authentication test to verify your identity.

If Acxiom is unable to successfully verify your identity, we will be unable to fulfill your requests to know. If we are unable to verify your identity, you will be notified and directed to see Acxiom’s privacy notice concerning our data collection, sale, and disclosure practices described in Acxiom’s US Products Privacy Notice.

You have the right to request that Acxiom disclose what personal information we collect, use, disclose, and sell or share about you.  We call this your “right to know.”  Consumers may request a consumer access report (“Consumer Access Report”) from Acxiom up to two times per twelve-month period.

Acxiom’s Online Consumer Portal

Upon successful identity verification as described above, to take advantage of your right to know, you may submit a request using our online consumer portal by visiting the Acxiom US Privacy Rights Portal. Upon receipt of your request via the online consumer portal, Acxiom will provide you with a “request ID” at the email address you submitted. Please retain this request ID, as we will use it to communicate with you throughout this process. We will also send you an additional email with instructions on how to complete your request through the online consumer portal. When completed, Acxiom will provide you with a Consumer Access Report that describes the personal information Acxiom has collected, sold, disclosed and/or shared about you in the last year.  For requests to know received through an authorized agent, Acxiom will return the Consumer Access Report directly to the consumer.

Appeals Process:  Acxiom provides consumers a formal method for appealing Acxiom’s refusal to take action on a request for access, deletion, correction, opt-out, or any other right afforded by state privacy laws.  An appeal may be submitted to Acxiom via the Acxiom Consumer Privacy Support Center.  In order to access the online consumer portal to submit a request for an appeal, you will need to provide the following information as part of the request:

• The original request for action for which you are requesting an appeal (e.g., deletion, identity verification)
• Original request identification number assigned to your request within the online consumer portal communications issues

Acxiom will accept requests from qualified third parties (“Authorized Agents”) on behalf of other consumers, regardless of the consumer or the Authorized Agent’s state of residence, provided that the Authorized Agent successfully completes the qualification procedures described below.

For the privacy and security of the consumer’s information, “requests to delete” and “right to know” requests submitted to Acxiom by an Authorized Agent will require a direct method of communication with the consumer, preferably a valid email address, to fulfill the request.

Authorized Agent Verification Requirements

In order to qualify as an Authorized Agent, businesses or individuals will be required to submit the following documentation:

Businesses Acting as Authorized Agent

If you are operating as a business, the following documentation is required:

• Written authorization document that includes each consumer’s name, address, telephone number and valid email address, signed and dated by each consumer authorizing you, as the authorized agent, to act on behalf of each consumer in making the request, (*Proof of written consumer authorization for opt outs are generally not required, except upon request by Acxiom to confirm such authorization); and
• Valid email address for each consumer for Acxiom’s direct correspondence with each consumer

Individuals Acting as an Authorized Agent

If you are an individual and acting as an Authorized Agent on behalf of a consumer, the following documentation is required to be provided to Acxiom as part of Authorized Agent verification process:

• Written authorization document that includes the consumer’s name, address, telephone number and valid email address, signed by the consumer authorizing you, as the Authorized Agent, to act on behalf of the consumer in making the request; or
• A “power of attorney” signed and dated by the consumer and notarized by a notary public naming you as the consumer’s authorized representative, which includes the consumer’s full name and physical address and the consumer’s month/year of birth.
• Unless you are qualified as an attorney-in-fact for a consumer as described above, Acxiom will require a valid email address for the consumer for Acxiom’s direct correspondence with the consumer.

Parent/Guardian of Minor Child

Acxiom does not sell information about minors.  Please see Acxiom’s privacy notice concerning Acxiom’s data collection, sale, disclosure and sharing practices described here.  If you are a parent or guardian of a minor child under 16 and would like to make a request for a right to know or deletion on behalf of the minor child, the following documentation will be required to be provided to Acxiom as part of the initial verification process:

• The minor’s verification documents, which include any of the following:
• • A certified copy of the minor’s birth certificate or adoption decree
  • The Minor’s health insurance card (issued by the insurance company)
  • • Medicare/Medicaid are accepted
  • The minor’s Social Security card
  • Certified school record or transcript or home school notice of intent form that includes minor’s permanent address
• Proof of parental/guardianship identity document that matches the minor’s permanent residence, which includes one of the following:
• • Minor’s court order establishing custody
  • Minor’s order establishing guardianship
  • Court issued parental responsibility (for example, court documents on file with presiding court)
  • Current month’s utility bill with parent/guardian’s name and address shown

*For the safety and security of the minor child, no location information will be provided in any Consumer Access Report issued.

California consumers are entitled to make certain requests of covered businesses as described in the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively the “CCPA”). The following instructions are provided to assist you or your authorized agent in making your request to Acxiom.

Requests to Limit Use of Sensitive Personal Information

Pursuant to the CCPA, California consumers have a right to request a business limit the use of “sensitive personal information” about them that Acxiom has collected or maintained. “Sensitive personal information” includes (1) (A) A consumer’s social security, driver’s license, state identification card, or passport number; (B) A consumer’s account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; (C) A consumer’s precise geolocation (1850 ft radius); (D) A consumer’s racial or ethnic origin, religious or philosophical beliefs, or union membership; (E) The contents of a consumer’s mail, email, and text messages unless the business is the intended recipient of the communication; (F) A consumer’s genetic data. (2)(A) The processing of biometric information for the purpose of uniquely identifying a consumer; (B) Personal information collected and analyzed concerning a consumer’s health; and (C) Personal information collected and analyzed concerning a consumer’s sex life or sexual orientation. Acxiom will treat a request to limit our use of your sensitive personal information as a request to delete.

Instructions for Authorized Agents Exercising Rights on Behalf of Consumers

The CCPA allows California consumers to use “Authorized Agents” to submit requests to Acxiom on their behalf.  If you have elected to use an Authorized Agent, or if you are an authorized agent who would like to submit requests on behalf of a consumer, the following procedures will be required prior to acceptance of any requests by an Authorized Agent on behalf of a California consumer. In addition, Acxiom will accept requests from qualified third parties on behalf of other consumers, regardless of either the consumer or the authorized agent’s state of residence, provided that the third party successfully completes the qualification procedures described below.

For the privacy and security of the consumer’s information, “requests to delete” and “right to know” requests submitted to Acxiom by an Authorized Agent will require a direct method of communication with the consumer, preferably a valid email address, to fulfill the request.
