U.S. Data Product Privacy Notices

Acxiom has two primary lines of business. One is a broad line of data management services to help our clients efficiently manage their customer and potential customers’ information. The second line of business is a suite of data products that focus on marketing. Clients use Acxiom’s marketing data products to better market to their existing and prospective customers. These lines of business are described in more detail below.

Acxiom’s Data Management Services

We provide solutions to help our business clients manage, use, and optimize their customer data and to help them identify and reach potential new customers using analytical tools and marketing and advertising strategy services. Stated differently, we design, build, and run processes for our business clients to help them manage their data, and we provide the tools and resources to help our clients better understand their customers and identify potential customers who are similar to their best customers.  Our data management services help our clients implement marketing lifecycle improvements, new ways to connect with consumers, and website experience optimization. When we provide data management services, we process our clients’ and their partners’ information according to contracts with our clients. In that capacity, we are acting as a service provider, sometimes called a processor.

Acxiom’s Marketing Data Products

Acxiom’s marketing products are used by qualified companies, non-profit organizations, government agencies, and political organizations in their marketing, fundraising, customer service, and constituent service and outreach programs. Acxiom does not provide services or data to individual consumers.  Our marketing products are used to enhance customer and constituent files and to provide lists for prospecting and fundraising purposes. Acxiom’s clients use our marketing and advertising products to offer goods and services through various advertising channels and to provide customers and prospects with better service, improved offerings, and special promotions.

For a company to use Acxiom’s products and services, it is required to enter into a contract with us.  The terms of those contracts govern the use of personal information Acxiom collects, processes, sells, shares and discloses to clients.

In addition to disclosures of information in the ordinary course of business, we may disclose personal information as necessary to comply with a legal obligation or to respond to law enforcement or a regulator, such as in response to a subpoena.

Acxiom’s data products contain only the information required for its intended use. Acxiom’s data products are designed for a specific use by our clients that have a legitimate need for the product.

Products for Marketing and Advertising Purposes: 

These products contain information about individuals and households in the U.S. and are developed from many sources, including:

• Public record and publicly available information: Examples include real property recorder records and assessor records
• Data from other information providers (sometimes called “data brokers”):
  Examples include demographic information, consumer contact information, surveys, and questionnaires with appropriate notice regarding what information is collected, why it is being used, and with whom it is being shared. Acxiom also collects summarized or aggregated purchase information and other aggregated information.

The Acxiom marketing and advertising products we license to clients do not include specific details about a purchase, detailed financial information, credit information, or information identifying or revealing a person’s past, present, or future, physical or mental health condition. Where permitted by law, Acxiom’s marketing and advertising products may include information such as date of birth, race, ethnicity and religious affiliation. Also, where permitted by law, we license Social Security numbers regarding deceased U.S. citizens (“Limited Access Deathmaster File”), primarily to suppress recently deceased individuals from pending marketing campaigns and for use by financial institutions to confirm and facilitate beneficiary benefits.

Collection and Use of Minor Data: We will not disclose identifiable information on anyone younger than 18 to third parties for use in marketing solicitations.  We do use information related to minors younger than 18 to identify and remove records about them from our and our clients’ marketing files.  We also use information related to minors younger than 18 in creating additional insights solely related to the adult parent of the minor individual, (for example, Acxiom creates a flag that denotes “presence of children” and attributes such as “child age ranges”). However, Acxiom does not disclose identifiable information about the minor as part of the insights created and included within the adult record.

Collection and Use of Geo-Location Data: Acxiom does not collect “movement data” as that term is generally understood in marketing. We do not track where a person is or has been from moment to moment (i.e., device ID, latitude and longitude plus timestamp in five minute or less increments). We do collect information related to visits to commercial locations, such as restaurants, retail stores, and car dealerships (e.g., pseudonymous device ID, latitude and longitude, timestamp and duration of visit). We do not collect information related to visits to sensitive locations such as places of worship, domestic abuse shelters, drug and alcohol treatment centers or reproductive health clinics.

Collection and Use of Deidentified Data: Acxiom collects deidentified information (as that term is defined in applicable US statutes) that are used to build our marketing models. Acxiom commits to maintain and use such information in its deidentified form and not attempt to reidentify the information.

Collection and Use of Retail Purchase Data: Acxiom does not collect individually identifiable information regarding retail purchases at a granular level (i.e., at a “SKU”- level). Instead, Acxiom collects identifiable retail purchase information at category levels (e.g., “health & beauty products,” “clothing,” “electronics”).

Offshoring:  Where permitted by law, third parties under contract to Acxiom may have access to the information in Acxiom’s marketing and advertising data products to assist in processing the data. Some of these third-party service providers or contractors may reside outside the United States.

During the last year, Acxiom has sold personal information it has collected to our clients and others, including ad tech partners, for their business and commercial purposes.  More specifically, Acxiom licenses personal information to third parties for the purpose of enabling and improving their marketing and advertising campaigns; from identifying potentially interested consumers to measuring the effectiveness of the marketing and advertising campaign.  We also license personal information for the purpose of identity recognition and resolution services (i.e., recognizing different records as relating to the same person) and marketing analytics, including the creation of marketing and propensity models through human and computerized analytics. Acxiom does not sell personal information to individual consumers.

During the last year, Acxiom has disclosed personal information to service providers and contractors (e.g., cloud computing and storage vendors; security contractors, and consultants), for Acxiom’s own operational business purposes.

Acxiom does not sell personal information about consumers younger than 18 for the purpose of marketing or advertising directly to the minor.  Acxiom does use personal information from minors younger than 18 to suppress matching records from marketing lists and to facilitate identity recognition and resolution.

Acxiom does not engage in profiling or automated decisioning in furtherance of “decisions that produce legal or similarly significant effects.”

Opt Out from Acxiom’s Data Products

Acxiom offers consumers the opportunity to opt-out of our data products at no cost. Acxiom’s products include “targeted advertising” as defined by applicable US state privacy laws and as such, consumers choosing to opt out of our data products will also be opted out of targeted advertising.

Acxiom utilizes the Association of National Advertisers’ DMAchoice™ Mail, Telephone, and E-mail Preference files, as well as the various state registries and the Federal Trade Commission’s Do-Not-Call Registry in developing our marketing data products.

Consumers registered with the ANA, the FTC, or any of the state Do Not Call registries can, but do not need to, also opt out with Acxiom, directly, to prevent the use of their information for marketing purposes.

Consumers who wish to opt out of Acxiom marketing data products, including targeted advertising, may complete and submit an opt-out request form by clicking /optout/

Separately, consumers may also want to utilize opt-out options offered by independent third party organizations such as Digital Advertising Alliance opt out program, http://www.aboutads.info/choices/ or the Network Advertising Initiative opt-out program http://optout.networkadvertising.org/.

Acxiom will accept opt-outs from qualified third parties on behalf of other consumers, regardless of the consumer or agent’s state of residence, provided that the third party successfully completes certain qualification procedures. Acxiom has adopted the qualification procedures prescribed under California law for validation of such third parties as described here.

Access and Deletion Rights. In addition to opt-outs, Acxiom provides consumers nationwide, regardless of their state of residence, the right to make access and deletion requests. If you would like to submit a request, you may do so by filling out a request on our online consumer portal found here.

Appeals Process: Acxiom provides consumers a formal method for appealing Acxiom’s refusal to take action on a request for access, deletion, correction, opt-out, or any other right afforded by state privacy laws. An appeal may be submitted here.

European Union Model Contracts: As a global company, Acxiom complies with many countries’ privacy laws. Acxiom maintains an industry-recognized leadership role in consumer privacy. Acxiom has executed EU and UK approved standard contractual clauses with its EU and UK affiliates to ensure ongoing compliance with the international transfer principle as set out in the EU and UK’s General Data Protection Regulation.

Accuracy: Acxiom maintains quality control procedures to ensure the information we compile and process is as accurate and complete as possible. Acxiom responds promptly to questions from clients and consumers about the accuracy of information.

Security: Acxiom maintains security procedures designed to keep information we own, license and process from being accessed by any unauthorized person or business. We use a variety of multi-level security systems to control access to our services and data products. All users at client locations, as well as all Acxiom associates, must have the appropriate access credentials and be authorized to access certain data and applications.

Acxiom conducts risk assessments and regular audits on our internal and external information systems to assess our ability to maintain the integrity of client and Acxiom data. Our enterprise security operations center maintains real-time monitoring for information system vulnerabilities and unauthorized access attempts into our internal systems. We also maintain physical security for our facilities and limit access to certain critical areas of our business.

We take reasonable precautions to ensure that our security procedures are adequate for the protection of our computer systems and data, but this does not eliminate the possibility that our security will be breached. If a security breach causes Acxiom leadership to believe individual consumers are at actual risk for identity theft or other fraudulent activities that may cause substantial harm or inconvenience to consumers or if such breach otherwise requires public notification, Acxiom will post a security alert notice on our website (www.acxiom.com) that will provide relevant information for consumers and Acxiom clients to consider to protect against fraudulent and other harmful actions that may result from the unauthorized access.

Compliance: Acxiom participates in industry efforts to establish fair and workable guidelines above and beyond current laws and regulations and believes such actions are an effective way to protect privacy in the marketplace. We also support legislation and regulatory efforts to introduce fair and workable guidelines that protect privacy of consumers.

We actively work to ensure that such guidelines are consistent with and complement established self-regulatory measures and that they enable the consumer to continue receiving the benefits that appropriate information use provide.

When Acxiom provides data management services to our clients, we process their information in strict accordance with the terms and conditions of the contract. Some of the services we provide companies such as financial institutions and healthcare organizations are governed by laws including the Fair Credit Reporting Act, Gramm-Leach-Bliley, the USA PATRIOT Act, and the Health Insurance Portability and Accountability Act. In these and similar situations, Acxiom works closely with our clients to ensure the processing we perform is in accordance with all the laws governing those activities.

Awareness: Acxiom is committed to privacy education. We provide education to our clients, our associates, and consumers about the issues, guidelines and laws surrounding individual consumer privacy issues, corresponding responsibilities and Acxiom’s privacy policies and practices. Acxiom provides education and consultation to clients about privacy compliance and about the laws and industry guidelines that protect consumers. Acxiom representatives speak at various events and emphasize the importance of responsible data collection and use.

Privacy Policy Changes: From time to time Acxiom may update and revise our privacy policy based on changes in our business environment and changes to applicable law. We urge consumers and clients to periodically visit our website to understand any changes that may have occurred.

Our privacy policy contains an “effective date” reflecting when the last changes occurred.

The California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively the “CCPA” or the “Act”) confers privacy rights on California consumers and imposes corresponding obligations on businesses subject to the Act as described in this Section.

To respond to your right to know request, the CCPA permits Acxiom to verify your identity. This will require that you provide certain personal information for validation as well as satisfactorily answer a series of authentication questions administered through our consumer portal. If you call or mail us and request a consumer access report, an Acxiom associate will call you to administer an authentication test in which you will be required to answer certain questions to verify your identity.

If we are unable to satisfactorily verify your identity, we will be unable to fulfill your right to know request. In that case, please see the information below concerning Acxiom’s data collection, maintenance, and sale practices.

To respond to your right to delete request, the CCPA permits Acxiom to verify your identity. This may require that you submit certain personal information for us to compare and match to data we have about you.

Acxiom will retain certain personal information in our systems as necessary to comply with a legal obligation (including ensuring the deletion request is honored and record-keeping obligations), detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for the activity. In such cases, Acxiom will retain only the minimum amount of information that does not qualify for a statutory or regulatory exception, and only use the remaining data for the purposes provided by the statutory or regulatory exception.

Right to Limit Use of Sensitive Personal Information

Acxiom may use Sensitive Personal Information as a part of its marketing and advertising products.

Pursuant to the CCPA, California consumers have a right to request a business limit use of “sensitive personal information” about them that Acxiom has collected or maintained. “Sensitive personal information” includes (1) (A) A consumer’s social security, driver’s license, state identification card, or passport number; (B) A consumer’s account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; (C) A consumer’s precise geolocation (1850 ft radius); (D) A consumer’s racial or ethnic origin, religious or philosophical beliefs, or union membership; (E) The contents of a consumer’s mail, email, and text messages unless the business is the intended recipient of the communication; (F) A consumer’s genetic data. (2) (A) The processing of biometric information for the purpose of uniquely identifying a consumer; (B) Personal information collected and analyzed concerning a consumer’s health; and (C) Personal information collected and analyzed concerning a consumer’s sex life or sexual orientation. Acxiom will treat a request to limit our use of sensitive personal information as a request to delete.

Right to Non-Discrimination

The CCPA protects California consumers who exercise their rights from discrimination. Acxiom will not discriminate against consumers who request access to personal information about them, request deletion, or request that Acxiom opt them out of future sales.

Right to use Authorized Agents to Exercise Rights

The CCPA allows California consumers to use authorized agents to submit requests to Acxiom on their behalf. In addition, Acxiom has expanded these rights to allow consumers to use authorized agents regardless of their State of residence. Acxiom requires that the authorized agent provide written authorization from the consumer to act on the consumer’s behalf. In the case of an authorized agent’s request for access to personal information, the resulting report will be delivered to the consumer directly.

Disclosure and Sale of Personal Information

During the last year, Acxiom has sold personal information it has collected to our third-party clients for their business and commercial purposes. More specifically, Acxiom licenses personal information to our clients for the purpose of enabling and improving marketing and advertising campaigns from identifying potentially interested consumers to measuring the effectiveness of the marketing and advertising campaign. We also license personal information for the purpose of identity recognition and resolution services and marketing analytics. Acxiom does not sell personal information to individual consumers.

During the last year, Acxiom has disclosed personal information to service providers (e.g., cloud computing and storage vendors; security contractors, and consultants), for Acxiom’s own operational business purposes.

In such cases, Acxiom will retain only the minimum amount of information that does not qualify for a statutory or regulatory exception, and only use the remaining data for the purposes provided by the statutory or regulatory exception.

Right to Non-Discrimination

The MCDPA protects Montana consumers who exercise their rights from discrimination. Acxiom will not discriminate against consumers who request access to personal information about them, request deletion, or request that Acxiom opt them out of future sales.

Right to Use Authorized Agents to Exercise Rights

The MCDPA allows Montana consumers to use authorized agents to submit requests to Acxiom on their behalf. In addition, Acxiom has expanded these rights to allow consumers to use authorized agents regardless of their State of residence. Acxiom requires that the authorized agent provide written authorization from the consumer to act on the consumer’s behalf. In the case of an authorized agent’s request for access to personal information, the resulting report will be delivered to the consumer directly.

The TDPSA protects Texas consumers who exercise their rights from discrimination. Acxiom will not discriminate against consumers who request access to personal information about them, request deletion, or request that Acxiom opt them out of future sales.

Right to Use Authorized Agents to Exercise Rights

The TDPSA allows Texas consumers to use authorized agents to submit requests to Acxiom on their behalf. In addition, Acxiom has expanded these rights to allow consumers to use authorized agents regardless of their State of residence. Acxiom requires that the authorized agent provide written authorization from the consumer to act on the consumer’s behalf. In the case of an authorized agent’s request for access to personal information, the resulting report will be delivered to the consumer directly.

The Utah Consumer Privacy Act (the “UCPA”) confers privacy rights on Utah consumers and imposes corresponding obligations on businesses subject to the UCPA.

The following is intended to explain a consumers’ rights and the obligations Acxiom has under the UCPA.

Right to Know/Request for Access to Personal Data

As a consumer under the UCPA, you have the right to request that Acxiom disclose what personal data we collect, the purpose for which we use the personal data, as well as the categories of personal data that we disclose and sell about you. We call this your “right to know.”

To respond to your right to know request, the UCPA permits Acxiom to verify your identity. This will require that you provide certain personal data for validation as well as satisfactorily answer a series of authentication questions administered through our consumer portal. If you call or mail us and request a consumer access report, an Acxiom associate will call you to administer an authentication test in which you will be required to answer certain questions to verify your identity.

If we are unable to satisfactorily verify your identity, we will be unable to fulfill your right to know request. In that case, please see the data below concerning Acxiom’s data collection, maintenance, and sale practices.

TYPES OF PERSONAL DATA ACXIOM COLLECTS/PROCESSES

Right to Know about Personal Data Collected, Disclosed, Sold, or Shared

Acxiom licenses the categories of personal data described below from the third-party sources categorized below in developing Acxiom’s marketing and advertising products as previously described. Acxiom licenses such data products to categories of third parties as described in the table below.

We also collect personal data for commercial purposes. The commercial purpose for which we collect/process personal data is to provide marketing and advertising products, including identity recognition and resolution services and marketing analytics

Except for consumer surveys that are used to build our marketing and propensity models, Acxiom does not collect data directly from consumers for use in our data products. Please also note that Acxiom does not collect biometric information from consumers who are not Acxiom employees. Lastly, Acxiom does not collect sensory information such as voice, visual, thermal, olfactory, or similar sensory information.

DISCLOSURE AND SALE OF PERSONAL DATA

During the last year, Acxiom has sold personal information it has collected to our third-party clients for their business and commercial purposes. More specifically, Acxiom licenses personal data to our clients for the purpose of enabling and improving marketing and advertising campaigns from identifying potentially interested consumers to measuring the effectiveness of the marketing and advertising campaign. We also license personal data for the purpose of identity recognition and resolution services and marketing analytics. Acxiom does not sell personal data to individual consumers.

During the last year, Acxiom has disclosed personal data to service providers (e.g., cloud computing and storage vendors; security contractors, and consultants), for Acxiom’s own operational business purposes.

Acxiom does not sell personal data about consumers younger than 18 for the purpose of marketing or advertising directly to the minor. Acxiom does use personal data from minors younger than 18 to suppress matching records from marketing lists.

Acxiom does not engage in profiling in furtherance of “decisions that produce legal or similarly significant effects.”

Right to Delete Personal Data

Utah consumers have a right to request deletion of personal data about them that Acxiom has collected or maintained.

Right To Opt Out of the Processing of Sensitive Data

Acxiom may use Sensitive Data as a part of its marketing and advertising products. Pursuant to the UCPA, Utah consumers have a right to opt out of the processing of their “sensitive personal data” about them that Acxiom has collected or maintained. “Sensitive personal data” includes personal data that reveals: (A) an individual’s racial or ethnic origin; (B) an individual’s religious beliefs; (C) an individual’s sexual orientation; (D) an individual’s citizenship or immigration status; or (E) information regarding an individual’s medical history, mental or physical health condition, or medical treatment or diagnosis by a health care professional;

(ii) the processing of genetic personal data or biometric data, if the processing is for the purpose of identifying a specific individual; or

(iii) specific geolocation data (1750 ft radius or less). Acxiom will treat a request to opt out of the processing of sensitive personal data as a request to delete.
